1. Definitions

1.1 “our site” means www.channelislands.coop, any subdomain or any other website operated by us, including:

1.2  The Channel Islands Co-operative Society Limited (the “Society”, “us”, or “we”), its subsidiaries and all affiliated entities is registered under the Industrial & Provident Societies Act 1965 - 1978 (Industrial & Provident Societies (Channel Islands) Order 1965 - 1978) and has its registered office at Co-operative House, 57 Don Street, St Helier, Jersey JE2 4TR. The Society is registered with the Mutuals Section of the Financial Conduct Authority in the United Kingdom (Number 14672R). The Financial Conduct Authority acts as registrar for Industrial & Provident Societies (Co-operatives).  The Society’s subsidiaries and affiliated entities are as follows:

By using our site, you confirm that you accept these terms & conditions and that you agree to comply with them. If you do not agree to these terms & conditions, you must not use our site. We recommend that you print a copy of these terms for future reference.

We have the right to disable any account, user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms and conditions of use or any other policy referred to in these terms of use.

You are responsible for all activity on your account. If you know or suspect that anyone other than you knows your user identification code or password, you must promptly notify us.

5. Using our site

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

By breaching this provision, you would commit a criminal offence under the Computer Misuse (Jersey) Law 1995 and / or the Computer Misuse (Bailiwick of Guernsey) Law, 1991. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

You may use our site only for lawful purposes. All information which you provide to us must be true, accurate, current and complete in all respects. You will notify us as soon as possible of any changes to such information. You may not use our site:

  • in any way that breaches any applicable local, national or international law or regulation;
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect;

  • to access without authority, interfere with, damage or disrupt any part of our site, any equipment or network on which our site is stored, any software used in the provision of our site or any equipment or network or software owned or used by any third party.

Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources and such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

Our site may include third party content. This third party content has not been verified or approved by us and we are not liable or responsible for any such content. The views expressed by any third party on our site do not represent our views or values.

8. Links to our site

You may link to the homepage of our site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

We reserve the right to withdraw linking permission without notice.

9. Uploading content to our site

You warrant that you have the right to grant this licence.

You waive your moral rights to the extent permitted by law in your content. This means that we do not need to identify you as the author of any content and you cannot object to any derogatory treatment.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

12. General Terms

12.1 Indemnity and warranty

You agree to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand and in full, from and against all claims, liability, damages, losses, costs and expenses, including reasonable legal fees, arising out of your breach of these terms & conditions  or any other liabilities arising out of your use of our site. This means that you will be responsible for any loss or damage we suffer as a result of your breach of these terms & conditions.

12.2 Suspension or withdrawal of our site

Our site is made available free of charge. We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.

12.3 Validity of these terms & conditions

If any part or provision of these terms & conditions is found to be unlawful or unenforceable, this shall not affect the validity of any other part or provision.

12.4 Applicable law and jurisdiction

These terms & conditions, their subject matter and their formation, are governed by Jersey and / or Guernsey Law. You and we both agree that the courts of Jersey and / or Guernsey will have exclusive jurisdiction over any dispute relating to these terms & conditions.
